For the majority of cases that we help clients with, it is common for matters to settle without the need for a full trial or for you to ever set foot in a court room. This allows you to have your legal, licencing, and insurance interests protected while being able to meet your work or school obligations without costly interruption. If you have been charged by the police, it is important to know the penalties that will be incurred by a conviction and how the court process works.
Some defendants simply plead guilty to their charges without being aware of the costly licencing, demerit point, fine, licence suspension, insurance, or imprisonment penalties that will result from that conviction. Beyond the standard penalties, novice drivers such as G1 or G2 licence holders are also subject to ‘escalated sanctions’ for offences that carry 4 or greater demerit point penalties. These additional penalties range from suspension to revocation of the driver’s licence. Once you have been convicted by the court by pleading guilty, trying to undo that conviction becomes a much more expensive legal endeavour that will generally have poorer results than having properly dealt with it in advance of conviction.
Our OTD team can generally review your case and provide you basic information about your charges and the court process within as little as 10 to 15 minutes for simple matters. We offer a no cost, no obligation review of matters by calling our toll-free number at [wtsphone city=”tollfree”] or via email firstname.lastname@example.org, through our website at https://www.otdlegal.ca/contact, or at any of our offices in person. For almost all cases we can provide you with a relatively low, flat rate cost for the legal work involved so that you can make an informed decision about the costs and benefits of contesting your case at court. The majority of cases we assist clients with can be resolved in advance of trial by meeting with the Prosecutor on their behalf. We will file for a release of the evidence that will be held against you at trial, and review it with the Prosecutor at an early resolution meeting. Where possible, our first goal is to simply have any charges issued against you withdrawn based on the legal merits of the Prosecutor’s case. If the charges issued against you cannot be withdrawn, we will then negotiate in your best interests to reduce the number or the nature of charges you are facing, or the penalties associated with those charges. If an acceptable resolution cannot be reached, you will then have the advantage of having a licenced and experienced paralegal to argue on your behalf at trial.
Our paralegals regularly assist clients such as yourself with simple charges such as speeding, operate motor vehicle with no licence, disobey stop sign, driver fail to properly wear seatbelt, or amber/red light fail to stop. We also assist commercial motor vehicle drivers with MTO offences, as well as defendants who have been charged with very serious offences such as careless driving, operate motor vehicle no insurance, drive under suspension, fail to remain at the scene of a collision, stunt driving/race motor vehicle, fail to stop for school bus, or provide false information to a police officer.
Our friendly and knowledgeable team are here to help you. Know your rights and the consequences of a conviction before making a hasty decision that could have life altering consequences.
