In Ontario, motorists must keep their license plates free from obstruction. As per the Highway Traffic Act, obstruction includes, but is not limited to, the peeling, fading, and natural deterioration of the plate over time. This means that even if you did not mean to obstruct your plate, you can be charged under the Highway Traffic Act.
The charge, under section 13(2) of the Highway Traffic Act, reads, “Every number plate shall be kept free from dirt and obstruction and shall be affixed so that the entire number plate, including the numbers, is plainly visible at all times, and the view of the number plate shall not be obscured or obstructed.” A charge under section 13(2) carries an $85.00 fine and, if convicted, will appear on your driving record and will be visible to your insurance company.
If your plate is peeling or fading, you must visit a Service Ontario to get a replacement in order to avoid being charged under section 13(2). The cost is $59.00, and you must bring the following items: identification, proof of insurance, the original vehicle permit (plate and vehicle portion).
