I just got a ticket for “crowding” my drivers seat. I didn’t have A CROWD on my drivers seat. I had a bag of groceries on my lap not a CROWD. I was the only person in the car. Can you win this if I fight it?

You have probably been charged under section 162 of the Highway Traffic Act (your ticket should list this on the front about half way down from the top). If so, a conviction would result in a 3 demerit point penalty. This certainly isn’t a very common offence to see being issued, but I would be happy to assist you with it.

Crowding Driver’s Seat
162. No person shall drive a motor vehicle with persons or property in the front or driver’s seat so placed as to interfere with the proper management or control of the motor vehicle. R.S.O. 1990, c. H.8, s. 162.
